5.2     By ordering products online, you acknowledge and agree that the use of the online ordering application and/or processes is at your own risk. To the maximum extent permitted according to the applicable law, in no circumstances, will we be liable for any direct, indirect, incidental, special, consequential, or punitive damages, losses, costs or expenses nor for any loss of profit that results from the use of, or inability to use this online ordering and/or any application and/or material on any site linked to this online ordering application (including but not limited to any viruses or any other errors or defects or failures in computer transmissions or network communications) even if we have been advised of the possibility of such damage. In addition, no liability can be accepted by us in respect of any changes made to the content of the online ordering application and/or process by unauthorised third parties. All express or implied warranties or representations are excluded to the maximum extent permitted according to the applicable law.

5.3     If you decide to order online using the online ordering application, you may be asked to provide full contact details and/or to create an account and you may need to accept cookies. You must keep your data confidential and must not disclose it to anyone. We reserve the right to suspend the use of the online ordering application and/or process if you breach these Terms of Use.

5.4     You acknowledge and agree that all orders are treated as an express intention to purchase the nominated products for the agreed online prices and we treat this as a binding offer from you to purchase such products. Any variations must be in writing, otherwise they will not be binding on either party.

5.5     We reserve the right to refuse any service, terminate your access to the online ordering application and/or process, remove or edit any content or accept your order/s in our sole discretion and without prior notice to you. Our online ordering application must only be used by persons over the age of 18 years, or the minimum legal age as permitted by the law or otherwise under the supervision of an adult or guardian.

5.6     The acceptance of any order for any of the products will be at our entire discretion. Our acceptance of an order may occur when you receive an on-screen message and/or email notification and/or an SMS, confirming your order.

5.7     Any products provided through the online ordering application are done so on an “as is” and “if available” basis and we expressly exclude any warranties, conditions, representations or other terms with respect to the online ordering or the content or products displayed on it, whether express or implied, unless expressly stated to the contrary.

5.8     Note that if you order online, the price charged may be different to the price for the products had they been ordered in-person, by email or by telephone.

5.9     The pictures of the products are for presentation only. The ordered products may have differences (for example, colour and form) towards the photos existing on the site. We are not liable in any way if the description of products is not complete.

5.10     You can pay by any of the methods listed in our checkout screen. Please ensure that if your order is placed using a credit or debit card, that the card is valid on the date of your order placement. We may provide no refunds to the orders paid online. Contact us directly to settle any payment dispute or refund claim.

5.11     Once the online order is placed it cannot be modified or cancelled either through the website or offline by calling us. Anyhow, if you wish to cancel or complain about your order, please call us and we can see how we can help you.

5.12     We will aim to provide you with your ordered products as close as possible after your order is placed but we cannot guarantee the delivery time in all the cases. For orders placed on a non-business day, delivery may in some cases be on the next business day. 

6. TRAVEL SERVICES

6.1     If you intend to engage us to provide you with travel services, then such travel services will be governed by a separate set of terms and conditions which we will provide to you prior to purchase of those services.

7.1     Certain content, products and services available via our Services may include materials from third-parties. Third-party links on this website may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

7.2     We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. All such rights are reserved by us and our licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise. 

14. INDEMNIFICATION

Please notify us immediately if you have any objections to us providing your personal information to any overseas recipient. 

6.6     You consent to the disclosure of all information necessary for our company to comply with any relevant reporting obligations (if any) pursuant to the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).

6.7     We will take all reasonable steps to ensure that any overseas recipient of your personal information does not willingly or knowingly breach the Australian Privacy Policy in relation to your personal information.

7. HOW WE STORE PERSONAL INFORMATION

7.2     When your credit or debit card account information is being transmitted to our services or through our services, it will be protected by cryptographic protocols. To be clear, we do not ourselves store your credit or debit card account information, and we do not have direct control over or responsibility for your credit or debit card account information. We use third party payment processors that are the controllers of your credit card information. Our contracts with third parties that receive your credit or debit card account information require them to keep it secure and confidential.

7.3     However, we cannot guarantee that transmissions of your credit or debit card account information or your other information will always be secure or that unauthorised third parties will never be able to defeat the security measures taken by us or our third-party service providers. Except to the extent that liability cannot be excluded or limited due to applicable law, we assume no liability or responsibility for disclosure of your information due to errors in transmission, unauthorised third-party access, or other causes beyond our control. 

7.4     We will only keep your information for as long as reasonably necessary to fulfil the purposes for which your personal information was originally collected.

7.5     We will delete your information after a reasonable time. You may be required to re-enter your personal information if it has been deleted.
